Terms of Service
These Terms of Service govern your use of Butterwhale, a service that uses AI to turn Airbnb listing photos into short promotional videos. By using Butterwhale, you agree to these terms.
1. Service
Butterwhale lets you submit a public Airbnb listing URL, select listing photos, and generate a short AI-assisted promotional video. Videos are sold as one-time digital products at the price shown at checkout.
2. Your content and responsibilities
You are responsible for the Airbnb URL, photos, text, and other content you submit or choose for generation. You confirm that you have the rights and permissions needed to use that content, including copyright, publicity, privacy, platform, and property-related rights.
You agree not to use Butterwhale to create content that is unlawful, misleading, infringing, harmful, or otherwise violates the rights of others. You remain responsible for reviewing generated videos before publishing or using them commercially.
3. AI-generated output
Butterwhale uses third-party AI and media processing services to generate videos. AI outputs may contain errors, artifacts, omissions, or creative interpretations. We do not guarantee that generated videos will be perfect, accurate, uninterrupted, or suitable for every use case.
4. Payments
Payments are processed by Lemon Squeezy as merchant of record. Pricing and taxes may be shown at checkout. Access to generation may require confirmation that payment was completed.
5. Refunds
Refunds are handled under our Refund Policy. In general, successfully generated and delivered digital videos are not refundable, except where required by law or where we decide otherwise at our discretion.
6. Service changes and availability
We may modify, suspend, or discontinue any part of Butterwhale at any time. We may also refuse, cancel, or limit service where we believe use of the service creates legal, technical, security, or abuse risks.
7. As-is disclaimer
Butterwhale is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
8. Limitation of liability
To the fullest extent permitted by law, Butterwhale and its operators will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages. Our total liability for any claim related to the service will not exceed the amount you paid for the specific video at issue.
